1. Acceptance of Terms
By accessing or using Kindred ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform. These terms apply to all visitors, users, and others who access or use the Platform.
2. Use of the Platform
You may use Kindred solely for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any way that violates any applicable federal, state, local, or international law or regulation. You must be at least 13 years of age to use the Platform. If you are under 18, you may only use the Platform with the involvement and consent of a parent or guardian.
3. Creator Accounts & Content
To publish content on Kindred, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. By submitting content — including text, images, video, and audio — you grant Kindred a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for the purpose of operating and improving the Platform. You retain all ownership rights to your original content.
4. Prohibited Content
You agree not to upload, post, or transmit content that: (a) is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) infringes on any intellectual property rights; (c) contains malware, viruses, or harmful code; (d) violates the privacy of others; or (e) promotes illegal activities. Kindred reserves the right to remove any content that violates these guidelines without prior notice.
5. Intellectual Property
The Platform and its original content, features, and functionality are owned by Kindred and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kindred.
6. Disclaimers & Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without any warranties of any kind. To the fullest extent permitted by law, Kindred disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. In no event shall Kindred be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
